Cloudy Bilişim Information Notice on the Protection and Processing of Personal Data
As Cloudy Bilişim, pursuant to Article 10 of the Law No. 6698 on the Protection of Personal Data, we would like to inform you about and provide clarification regarding our personal data processing activities.
- DATA CONTROLLER
In accordance with the Law No. 6698 on the Protection of Personal Data, your personal data may be processed, recorded, stored, classified, updated and, where permitted by applicable legislation and/or limited to the purposes for which they are processed, disclosed/transferred to third parties by Cloudy Bilişim, acting as the data controller, within the purposes explained below and in compliance with the law and the principles of good faith.
- PURPOSE OF PROCESSING PERSONAL DATA
Personal data belonging to our customers are collected and securely stored in physical or electronic environments in accordance with the KVKK and the periods specified in other applicable laws, for the purpose of providing sales and support services including Accounting Software, Invoice & Delivery Note Management, Current Account Management, Inventory and Warehouse Management, Income and Expense Management, Reporting Management, Marketplace Integration, Website Integration, Inventory Management, Online Payment, Stock Tracking, Employee Records & Asset Assignment Transactions, Attendance Tracking, Payroll Transactions, Leave and Travel Transactions, Assignment Transactions, Asset Tracking, Cost Tracking, Depreciation Calculation, Maintenance and Repair Tracking, Insurance Request Processing, Field Management, Online Work Tracking, Project Tracking, Performance Measurement, Reporting System, Periodic Profitability Calculation, Cost Calculation, Project-Based Profitability Calculation, Balance Sheet Tracking, Document Flow Management, Document Storage, Document Classification, Audit Facilitation, Document Tracking and Editing, Open Banking, Virtual POS Integration, Online DBS, Online Money Transfer and Online Receivables Tracking System.
Personal data belonging to former employees, current employees and personnel working as interns are collected for job application and employment processes, Social Security Institution notifications, İŞKUR notifications, KOSGEB applications and the implementation of Cloudy Bilişim’s physical security measures.
The personal data collected are protected by Cloudy Bilişim in accordance with all obligations stipulated under the KVKK and all other applicable legislation. The data subject may access detailed information about the purposes of processing personal data through the Personal Data Processing and Protection Policy stated under the Our Corporate Policies menu under the Corporate heading at http://localhost/cloudyen.
- DELETION OF PERSONAL DATA
The data subject may access detailed information regarding the deletion of personal data through the https://cloudybilisim.com/en/Kurumsal/kurumsal-politikalarimiz stated under the Our Corporate Policies menu under the Corporate heading at http://localhost/cloudyen.
- SHARING OF YOUR PERSONAL DATA
Personal data belonging to our customers and employees may be shared with Cloudy Bilişim’s solution partners, dealers, institutions and organizations with which it cooperates in order to conduct its activities, as well as contracted banks, provided that public interest is taken into consideration and in accordance with the fundamental principles set forth in the KVKK and the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK. In addition, personal data may be shared with public institutions and other organizations due to legal obligations and as required by applicable legislation.
No personal data held by Cloudy Bilişim is transferred abroad.
- PERSONAL DATA COLLECTED
As Cloudy Bilişim, we hold personal data belonging to employees and customers. The categories of personal data collected are listed below;
- Employee Personal Data:
Contact information, address information, bank account information, salary information, education information, certificate information, diploma grades, criminal record information, photographs, fingerprints for office security, employee call records, camera footage, employee email and registered electronic mail (KEP) addresses, identification information and reference information.
- Customer Personal Data:
Contact information, identification information, registered electronic mail (KEP) addresses, address information, email addresses, mother’s maiden name, nationality, tax number, Turkish ID or Passport No., signature, tariff information, call center voice recordings; for E-Payroll, employees’ identification information, contact information and email information.
- METHODS AND LEGAL GROUNDS FOR COLLECTING YOUR PERSONAL DATA
Personal data belonging to our customers are collected by Cloudy Bilişim through different channels and based on legal grounds for the purpose of carrying out its activities, through consultants or dealers via application forms or email. In addition, personal data may be collected through online applications, telephone support activities and electronic communication channels. Within this framework, your personal data may be processed and transferred with your explicit consent in accordance with the principles set forth in Article 4(2) of the KVKK, or without obtaining explicit consent where the circumstances specified in Articles 5(2) and 6(3) are present.
The legal grounds requiring us to collect personal data from our customers for the conduct of Cloudy Bilişim’s activities include the Electronic Signature Law No. 5070, the Tax Procedure Law No. 213 and related communiqués, the Turkish Commercial Code No. 6102, the E-BYS Correspondence Regulation No. 6321, the Labor Law No. 4857 and other related regulations.
Personal data belonging to former employees, current employees and personnel working as interns are obtained through online job application portals, job application forms and İŞKUR.
- RIGHTS OF THE DATA SUBJECT WHOSE PERSONAL DATA IS PROCESSED
You may exercise the following rights regarding the processing of your personal data by submitting a request to Cloudy Bilişim. Requests submitted within this scope will be concluded by Cloudy Bilişim free of charge within thirty days at the latest. However, if a fee is stipulated by the Personal Data Protection Board, Cloudy Bilişim may charge the fee specified in the applicable tariff. As the data subject, you have the following rights;
- To learn whether your personal data is being processed,
- To request information about the processing of your personal data if it has been processed,
- To learn the purpose of processing your personal data and whether it is being used in accordance with that purpose,
- To know the third parties to whom your personal data is transferred domestically or abroad,
- To request correction of your personal data if it has been processed incompletely or incorrectly,
- To request deletion or destruction of your personal data,
- To request notification of the correction, deletion or destruction of your personal data to third parties to whom your personal data has been transferred,
- To object to the occurrence of a result against you as a result of the analysis of your processed data exclusively through automated systems,
- To request compensation for damages if you suffer damage due to the unlawful processing of your personal data,
you have these rights.
